Planet K still operating in violation of permits

The Austin-based store obtained a permit by the city, but is continuing to receive violations and citations.

BRYAN, Texas -- Planet K is still operating even though they don't have the correct permits.

The Austin-based store says its employees have received tickets from the city for infractions on the sign, banner and selling merchandise in their parking lot.

Planet K says they have a permit from the City of Bryan that lets them operate in. The city confirms the store has a "Iterant Vendor Permit."

However, the permit is only valid for 21 days in the year and may only work for three consecutive days and then must be closed for a minimum of one day before reopening.

Planet K has already received a citation for operating on the fourth day.

Planet K owner, Michael Kleinman, says they are not going to pay it.

The city says they will continue to give out citations if the business keeps operating in violation of the permit.

According to zoning rules for the City of Bryan, Planet K is not zoned properly and can not sell its merchandise.

The building itself still has no electricity because of the permit disputes.
